BERLIN (Reuters) - A top German court ordered a cannibal to be retried Friday, saying his manslaughter conviction for killing and eating a willing victim was too lenient.

"The conviction only for manslaughter and not for murder does not stand up to legal review," the Federal Court of Justice said in a statement, upholding an appeal by prosecutors.

Armin Meiwes, 43, was sentenced to eight and a half years in January 2004 after a gory case that both fascinated and repulsed Germany and the world.

Meiwes admitted to killing a Berlin computer specialist, Bernd-Juergen B, he met via the Internet, but was spared a murder conviction as the victim had asked to be eaten in a startling case of sexual fetishism.

Prosecutors believed Meiwes should have been convicted of murder as he had killed to satisfy perverted desires. Meiwes' lawyer urged the lesser "killing on request," a form of illegal euthanasia that carries a maximum five year sentence.

If she was willing then there is something seriously wrong with her.

I suppose that as long as it can be confirmed that all parties, both eating and eaten, are willing in the practice of cannibalism, it's not so bad. I must place my support behind Meiwes in this instance as long as his meal was, indeed, a voluntary participant. This isn't a legal argument on my part, just one of personal belief.

I'm pretty sure there's more evidence onhand than just his word. Besides, it seems as though he's getting in a lot of trouble anyway. Cannibalism may be an odd practice to us today, but I see no reason for forbidding its practice when everyone is willing.

I must agree with Zeke. As long as both parties are willing, it shouldn't be illegal. Personally I don't see much of anything wrong with it. Its just a way of life.

From what I've seen, there must be. It doesn't seem to be in dispute.

A whole lot like pork, actually. A bit greasier, maybe.

Probably is a lot greasier, being that america has become so fat.

I suppose that's a valid solution. I don't see the point of locking him up though, if he's not killing anyone that doesn't want to be killed.

Anyone who is not concerned about keeping this guy out in society and doesn't think he needs to be locked up, and go to jail concern me.

The supposed "consent" is irrelevant. Murder is wrong, period.

I disagree. Killing is sometimes justified. When the victim wishes to die, it is assisted suicide, which I think is right. When the victim wants to kill you, it is self-defense. In war, innocents sometimes must be killed alongside the guilty to protect freedom and ideals, and this is justified. True pacifism is hard to come by. It's all about where you want to put the exceptions.

Assisted suicide is not murder unless the the victim is capable. Self-defense is not murder if one's life is at stake. Killing enemy soldiers who are capable of action is not murder.
