SAN JOSE, Calif. (AP) - A woman's meal at a Wendy's restaurant brought a whole new meaning to the term ``finger food.'' The woman bit into a portion of a human finger while eating a bowl of chili Tuesday night at the San Jose restaurant, Santa Clara County health officials said Wednesday.

The woman, who asked officials not to identify her, immediately spit out the finger and warned other diners to stop eating, witnesses said.

``Initially she did put this object in her mouth and did bite down on it and wasn't sure exactly what it was,'' Santa Clara County Health Officer Dr. Martin Fenstersheib said at a news conference. ``She's doing OK. Initially she was a bit grossed out it was described to me, and vomited a number of times.''

Fenstersheib said the finger had been cooked at a high enough temperature to kill any viruses.


Officials said the fingertip was approximately 1 3-8-inches long and a half-inch piece of fingernail was also found. They believe it belongs to a woman because of the long, manicured nail.


Health investigators seized all of the ingredients at the restaurant and are tracing them back to their manufacturer. They believe the finger got into the chili at an earlier stage.


``We have no evidence of any accident within the employees at the facility itself,'' said Ben Gale of the Santa Clara County Health Department. ``We asked everybody to show us they have 10 fingers and everything is OK there.''


The restaurant has had only one minor health violation stemming from a leaky vent, according to the San Francisco Chronicle.


``Food safety is of utmost importance to us,'' Wendy's spokesman Joe Desmond said in a statement. ``We are cooperating fully with the local police and health departments with their investigation. It's important not to jump to conclusions. Here at Wendy's we plan to do right by our customers.''

I don't know, but I've certainly been turned off fast food. First McDonalds and their chicken head, now this. Yeah, I can eat at home.

one could say she got the finger....

but it is gross thats why I always throughly check my fast food, if not to be safe just to make sure they gave me what I wanted.

I don't recall. I've heard of issues w/ Taco Bell and McDonalds, of the incredibly nasty variety. I've only been ordering chicken at those places for a LONG time, but I don't think I really need to go anymore...

I went to mcdonalds awhile ago I asked for a Number one (Big Mack, Fries and Drink) value meal well when I got the bag from them I didn't check it till I got home instead of a number one they gave me 3 freaking cheese burgers, no fries I went back to them with the recipt and they claimed since I left the property that I couldn't get a reorder from them. so in polite terms I told them to F off, so I go to Burger King but I don't go through the drive through when I get the bag I take it to a counter and I check it out. If it doesn't have what I want I make a show about it till they get it right.

i'm sure its just a freaky coincidence(sp?) that a finger ended up in her food.

They only got 1 violation for a leaky vent so they are not slacking anything. I odn't think it wolud happen again, and in general those kind of things don't happen tha often.

I'm going too Mcdonalds tomorrow, just speeching in some courage

Yuk yuk yuk!

I refused to buy the chicken nuggets in McDonalds till they changed it so they're only chicken breast in them now. Too worried about what was in them!

You're not always safe at home though.. my mother came across half a maggot in a frozen dinner she bought from a supermarket once. We got loads of vouchers and an apology but it still makes me a bit weary. I still have to eat though, and I can't cook, so I'll still eat ready meals

I don't eat fast foods from mc donalds or any burger place like that. I just get my tacos from del taco or taco bell. But that is just sick! This woman found a chicken head in a chicken nugget at mc donalds a while ago. lol, kinda gross.

It dosn't worry me because I dont eat chilli. Although when that chicken head thing happened my brother and cousin told me and it turned me off then for like a month, but I'm so over it now, I'd eat take away every day if I was allowed!

You get what you pay for! You wonder why that meal is an extra 30 cents off, you get the bargain brand, and next thing you know, you get the finger.

You know though, you should really be happy when that kinda stuff happens. Theres a protocol for when this happens, its called sueing. Just be litigious. In a good number of cases, you can win.

I love these stories, they make me wet myself laughing.
At my primary school I found a live caterpillar making a run for it across my salad. I was just glad that we had salad at my school.
My friend found chicken GUTS in her chicken burger at mcdonalds. She took it back and they gave her another one. Strangely enough, she didn't eat it.
You sometimes get mice in mars bars. They can't kill them with poisons in the factory as there's a risk of poisoning the food, but they get attracted to the nuts in the Snicker bars made in the same factory and fall in the chocolate vats and drown.
Another friend found a PENNY in a sainsbury's bread roll. It had oxidised and sorta leaked into the bread. Some bloke came to the door after they complained and gave them a bunch of flowers and a bottle of champagne to keep them quiet.

And of course, this discussion couldn't be without the urban myth of the two boys who took a bucket of KFC into a cinema. One of them bit into a large piece and the other one looked over to see to his horror blood leaking out the sides of the boy's mouth. Turned out a live rat had fallen in the deep fat frier.

That woman lives in Vegas. So anyways she says she is tired of all the reporters so she is dropping the lawsuit against wendy's.

She isnt really tired she just knows that the public knows she has lied about the finger and that the finger really belongs to a woman who had her finger bitten off by a big cat at the zoo and she put the finger on the chilli in order to ruin the restaurant chain.

"I say Wendys should sue her for millions of dollars in losses."

It is slightly dodging that no one at the meat processing plant reported a finger missing. It's probably all illegally based in Mexico, and their chilli is made of old worn out donkeys.

The arrest is the latest twist in the bizarre case about how the 11/2-inch finger tip ended up in a bowl of fast-food chili.

Ayala told police she found the finger March 22 while eating at a Wendy's in San Jose. She said she intended to sue but relented, claiming the publicity was too emotionally taxing.

When police and health officials failed to find any missing digits among the workers involved in the restaurant's supply chain, suspicion fell on Ayala, whose story has become a late-night punch line.

Ayala has a litigious history. She has filed claims against several corporations, including a former employer and General Motors (search), though it is unclear from court records whether she received any money. She said she got $30,000 from El Pollo Loco after her 13-year-old daughter got sick at one of the chain's Las Vegas-area restaurants. El Pollo Loco officials say she did not get a dime.

Earlier Thursday, Ohio-based Wendy's International Inc. announced it had ended its internal investigation, saying it could find no credible link between the finger and the restaurant chain.

All the employees at the San Jose store were found to have all their fingers, and no suppliers reported any hand or finger injuries, the company said.

Sales have dropped at franchises in Northern California, forcing layoffs and reduced hours, the company said. Wendy's also has hired private investigators, set up a hot line for tips and offered a $100,000 reward for anyone who provides information leading to the finger's original owner.
