WASHINGTON � The Bush administration is asking Texas to conduct new hearings for 51 Mexicans on death row who say they were denied legal help from their consulates in violation of international law.
The International Court of Justice (search) in The Hague last year ruled that the convictions violated the 1963 Vienna Convention (search) by not providing the Mexicans with consular access. In 1969, the Senate ratified the treaty, which requires such access for Americans detained abroad and foreigners arrested in the United States.
The Supreme Court filing is an attempt by the administration to quell international criticism and comes a month before justices were to hear arguments in the case of Texas death row inmate Jose Medellin (search), who is challenging his conviction and sentence as a due process violation.
Medellin is backed in his appeal by dozens of countries, legal groups and human rights organizations, as well as former American diplomats and the European Union (search).
The filing by Acting Solicitor General Paul Clement argues that it is President Bush's decision, not the court's, to determine whether the United States should comply with international law. Nevertheless, the administration has chosen to do so in this case, states the Feb. 28 filing, which was circulated Monday by the court.
"Compliance serves to protect the interest of United States citizens abroad, promotes the effective conduct of foreign relations and underscores the United States' commitment in the international community in the rule of law," Clement wrote.
The filing states that Medellin and other Mexican nationals can now seek a fresh review in state court, which will then reconsider their claims in a way that "the president has determined is an appropriate means to fulfill this nation's treaty obligations."
Texas attorneys had argued it was too late for Medellin to bring the challenge, because he failed at his trial to file objections that the Mexican government was not told of his arrest.
Medellin was one of five gang members sentenced to death for raping and murdering Jennifer Ertman, 14, and Elizabeth Pena, 16, in Houston in 1993.
There are 118 foreigners from 32 countries on death rows in America.
The case is Medellin v. Dretke, 04-5928.

agreed, but they have to face the punishment after they are tried as per the law. In this case International Law (The Vienna Convention) was broken.

I wish them luck. The ones named in this rape case are guitly as sin. If they have to use this dodge to save their useless hides, more power to them.

death row for rape? I don't think that is fair... Why can't they just serve a long ass term in prison? I'm sure they will regret every min of it because inmates LOVE when guys come in who sexually abused a kid in anyway! But put them to death because of rape? I think there are far worse things u can do in order to get death row... It just baffles me because my dad was murdred in a park... and the killer only got 5 years! lol... and ppl are getting death for rape? GEEZE what has this system come to?

I think rape is just as bad as murder. Although I disagree with the death penalty, if it is used I think it should apply to rapists as well as murderers.

It was a brutal gang rape with torture and murder. Sorry to hear about your father, but his killer's attourney "cut a deal", probably because the evidence was overwhelming against him and the lawyers are "encouraged" to cut deals on open-and-shut cases to save court costs and move on to trials where they can "make more of a difference".

I don't think rape is as bad as murder... I know from experience... Well, I wasn't murdred.. but still. Don't get me wrong, rape is a terrible thing for a person to have to go through.. But death always beats anything else.
I don't think rapists should be put on death row... I feel there are people out there who are doing things far worse.

oh, I didn't know it was a gang rape and murder... But i still don't feel death row is right here. I don't believe the government should have the power to decide wheather a person is to live or die.

I don't beleive the government should have the power to decide how I spend my money. I don't beleive the government should have the power to decide what I can and cannot say on TV. I don't think the government should have the power to decide what kind of guns I choose to carry, and where I carry them.
But if I kill an innocent victim, I do deserve to die. It's not the government who does it, it's the murderer in the first place.

Sorry hun, I disagree. Not saying that I believe in god or whatever, But I don't think the government should have the right to play one. I can understand having people on death row for serious terrible crimes... like terrorism and massave killings. What happened to taht little girl is very very sad, But u already know how i feel about that, No need to repeat myself.

1. "Long term in prison?" The death penalty IS an appropriate punishment.
2. A "long term in prison" is NOT sufficient. Only LIFE in prison is sufficient for such a thing, but death is more appropriate.
3. That is WRONG. He should have gotten the death penalty!

So you don't give a damn about the kids, is that what I'm reading? That makes NO sense to me. At all.
