A bill due before parliament next week will make it a criminal offence for two 15-year-olds to kiss in public, the Home Office said last night.

But officials said those below the age of consent were unlikely to be prosecuted if both were enjoying the embrace.

The revelation came after the Family Planning Association warned that the sexual offences bill, due for second reading in the Commons on Tuesday, threatened the young people it was supposed to protect.

Anne Weyman, the association's chief executive, said the bill would criminalise all consenting sexual activity among those under 16.

"This behaviour could include common petting activities such as kissing and touching, through to full sexual intercourse," she said.

"This kind of sexual exploration is completely normal and an important part of adolescent development. If the bill is passed without any amendments, such activity could carry a prison sentence of up to five years."

She said criminalising sexual activity would mean young people would be left without support, putting them at risk of unplanned pregnancies or sexually transmitted infections.

"The criminal law has a very poor record for influencing consenting sexual behaviour," she said. "The bill devalues true abuse from desired sexual activity by failing to distinguish the two."

The Home Office accepted Ms Weyman's interpretation of the bill, but said there was no plan to change it.

Meanwhile the latest attempt to revive the symbolic controversy over "section 28" restrictions on gay sex education failed in the House of Lords last night when the Tory peeress Lady Blatch failed to carry what her critics called a wrecking amendment to the local government bill.

Peers voted by 180 to 130 to reject an attempt by Lady Blatch to prevent repeal of the hated section until every school giving sex education had balloted parents.

"Mine is a simple mission to protect children from the worst form of sex education," Lady Blatch told peers after inheriting the pro-section 28 campaign from Lady Young who died last year.

Ben Summerskill, chief executive of Stonewall, the mainstream gay lobby, said: "This vote was a triumph for 21st century tolerance over 19th century prejudice. A noisy minority of politicians has defended this indefensible totem for far too long.

"We regret that organisations such as the Christian Institute found it necessary to resort to distortion and scaremongering in their attempts to frustrate this long overdue change in the law."

This is ridiculous! In the UK, sex if you're under 16 is illegal, and that's fine. However, two consenting 15 year olds, coming up to their 16th birthday, may decide that because of this they're going to stick to kissing and hugging. This bill, if it went through, would make it illegal for them to kiss in public. I kissed my boyfriends in public, even my first "boyfriend" when I was 10. There's nothing wrong with it, so why make it illegal?

HAHAHA...That is the most stupid proposal I have ever heard!

Yep. In all realism it should be up to the parents if anything. If a couple are engaged in kissing in public, then their obviously old enough. Things like birth control and std's should be taught to kids in primary and high school, it should not become so bad and out of control to become a law.

yeah i know i have firends who have babys and there just 16 and they regret it too.. and i know not to but it should not be a law some ppl who have done things like having babys and std's they have learned well..most of them anyway but yeah it is it just plane stupid for this law..

*beep*! What the hell? Who the *beep* do these idiots think they are? If people are in love they should be allowed to kiss even if their 9 years old, whatever! Here in Sweden we are allowed to have sex when we're 15, BTW.

I know they have done something smiliar in China where you couldn't kiss in schools. I don't fully agree but what The Goverment are trying to do is lower teenage pregnancies which The UK has the highest number in all of Europe. Still, lets not jump to conclusions....

I don't think that there would be many lower than 16 year old girls falling pregnant anyway.

What happens if it does happen. Throw them behind bars for 5 years and hope they learn a lesson? They get out of prison around the age of 19 or 20. I don't think it would prove a thing.

There where fears that under 16s who snog and fondle could face up to 5 years detention under the new sexual offences bill.
But home office minister Paul Goggins (Heehehe) said
"Criminalising teenagers who engage in kissing as part of their development is not the intention"

Well many of you think it is silly but many girls are becoming mothers at 16, especially in The UK which isn't good. Most of these babies end up being left in the streets or being born into unwanted families thus distrupting females lives. I'm not 100%, maybe 50%. This proposal will be to lower brithrates, like In China. I'm not sure about The US but over here it is bad and something needs to be done so what else could you do?

OK, I'll have to agree with the rest of the group! its a very ridiculas proposal that has been made!!

Come off it! I am in the west sussex police force and there is no way am I going up to a couple of 15 year olds to stop them kissing!! I did it when I was 15 so I dont see the problem!

However when ever I am out in public with my girlfriend I have to be quite consevative (Not kissing in public) because of what my occupation is I am always in the public eye!
