No, she should be punished, but not fired.
No, she was right to suspend the boy for speaking Spanish.

The attorney for 16-year-old Zach Rubio filed the lawsuit over the weekend. The suit details how the phrase "no problema" got Rubio suspended.

"You can't do that, this is America. You can't tell somebody not to speak Spanish just because it's your building," Rubio said.

Rubio is a junior at the Endeavor Alternative School. He has been taking classes to catch up on what he missed while caring for his family in Mexico.

The lawsuit alleged that Principal Jennifer Watts suspended Rubio after a teacher heard him say "no problema" in a school hallway.

"I said, 'What am I going home for?' She said, 'For speaking Spanish and we told you not to.' I asked, 'Why can't I?' She said, 'This is not Mexico, this not Germany,'" Rubio said. "My dad wasn't happy about it when he got home."

Rubio said his father complained to the principal and to Superintendent Bobby Allen.

"'You're not suspending my kid for fighting, for being disruptive for being disrespectful -- just speaking Spanish?'" said Rubio, detailing what his father asked the school.

Rubio said school officials told his father, "'Yes, that's correct, just speaking Spanish, and I don't want it here.'"

The suspension was later reversed, and Allen apologized to Rubio.

The lawsuit was filed against the school district and several teachers.

Rubio said he filed a lawsuit now because it seems to him that nothing happened to the people he believes wronged him.

"The same principal that suspended me, she's still there, the same teacher who sent me to the office, she's still there -- like nothing happened. I don't feel that there was justice and that's what I want," Rubio said.

The school district released a statement, saying it acted quickly in the matter and has apologized to Rubio and his parents.

The school has no policy prohibiting Spanish. Meanwhile, Rubio is back in school.

This is crazy.. Principal suspended him cause he spoke spanish. I call it racism. He didn't hurt anyone so what is the big deal?

Now I'm all for English being the state language of America, but whatever happened to freedom of speech? This is ridiculous. Can't speak Spanish. My gosh. Even I speak Spanish sometimes...ridiculous.

I'm thinking there's a small posibility that perhaps the kid was a troublemaker and possibly should have been suspended for something, so the school did the right thing, they just did it the wrong way?

Does anyone get what I'm saying?

But suspending someone for speaking spanish is like me getting a refferal for speaking German (<= happened, btw). Its racisim, its horrible, and its wrong.

And on a lighter note, this is the kind of thing I'd expect from K.C, Missouri (SP? I'm not having a good day)

Well, it's not racism, because there's no Hispanic race--it's Ethnic Discrimination, but I see your point.
It's ridiculous that you could get a referral for speaking German and that this kid could get suspended for speaking Spanish. I hope there's more to it, because if not, this is simply wrong.

Uh.... She was refering to the student being suspended for speaking spanish, Hitler and WWII is not the issue here.

Back to the issue:

I do not like this at all, Glad to see he's suing them. He lost valuble education time because someone didnt like that he was speaking spanish

I don't think he gives a crap about his education time, really. Honestly, few people do.
But this is still outrageous. And "no problema" is a phrase that everybody who speaks english understands anyway, unless you're really stupid.
Suing them is defenitely right for him to do, to express his contempt. And the Principal should be fired. Or demoted, whatever. Punished in some way.

I'm glad he's fighting back. This is ridiculus! Two words. Just two word, and not even mildly offensive ones! I'm not sure the principle should be fired, there's no way of knowing how good of a job they're doing, but they should definitly be punished. Freedom of speech - they weren't disrupting the learning enviornment (Tinker v. DeMoins).

I think there's more to the story than we're getting. This source seems very one-sided on the issue. I just find it slightly hard to believe that there isn't more to what happened than this. Obviously if he wants to make a big enough stink about being suspended for speaking Spanish, there must be a valid reason. However, the article doesn't give any DIRECT quotes from the teacher or any of the school officials. All it gives is Rubio "detailing" their responses. That's not good enough, and I think it makes him look extremely suspicious. I also doubt that he gives a flying fig about the education system.

Kansas is really on my nerves lately......

Yeah, that's why I'm not jumping to pin a punisment on the principle. I'm very interested to see what the principle's take on this is. But still, unless they can provide a more concrete reasoning, this is just ubsurd.

Yeah, if the article is how it really happened then I definately think the principal should be fired.
But I think there might be more to the story too.

Well, I'm glad someone agrees with me....everyone else seemed to jump on Rubio's side.......we need to consider this from all points of view. If we don't, you can imagine the ramifications........besides, just looking at one side of the story is too easy......

True, and I'm likely to believe that. But those are Rubio's words. I'd like to hear what the school has to say, even if it's just supporting his statement.

It depends what the exact rules of the school were, although I don't think someone should be chucked out for that. Maybe if the school had a "no other languages" policy then it might have been a punishment excersise at worst, but expulsion? That's just stupid.

No other language policy? wouldnt that to an extend be racist? especaly has the average High School Offers forieng language classes?
