She's trying to argue that gay adoption isn't under the law, thus the adoption can be thrown out. She is trying to gain custody of her child, if I read that correctly.

Ok, she wants custody, but...what does sexual orientation have to do with that? Is she being rejected because shes gay?

No, she's trying to say the adoption she made as a gay person with her "partner" is void because it's against the law. So, I'm guessing she's hoping that that will result in the child being taken away or something and giving her a chance to adopt him. I'm not sure.

Ok, that bothers me...shes hoping the child gets taken away, just so she can re adpot as a single mother? That sickens me, the child is being used as a pawn...
