Basically, the Supreme Court says that Newfoundland was justified in withholding pay equity rights in 1991 because of "financial hardships". It also hasn't specified any time when Newfoundland must make good on the equity payments. This basically gives governments across Canada the ability to claim financial difficulties as a reason for overriding the Charter of Rights and Freedoms. The Supreme Court says that it is only in extenuating circumstances, but it is a slippery slope . . .
