There wasn't enough hard evidence to make the case for removal of the feeding tube |

Tue Mar 08, 2005 11:55 am TERRI SCHIAVO - DEATH |
|
Who's heard about this case? Terri is a mentally handicapped woman, who is unable to swallow, but is fed w/ a tube straight to her stomach. Her husband wants the feedings to be discontinued, and for them to let her die.
She's not in a coma, she reacts to people, she can't speak, but she does make noises. She recognizes people, especially her mother.
Quote: | (CNN) -- The parents of Terri Schiavo asked a judge to allow the severely brain-damaged woman to divorce her husband -- even if she dies -- in one of a flurry of 11 new motions filed by the couple.
In the divorce motion filed Monday, Bob and Mary Schindler accused Michael Schiavo of adultery and not acting in his wife's best interests. The Schindlers have less than three weeks to find a way to keep their daughter alive before her feeding tube is removed.
"We have filed divorce proceedings because of (Schiavo's) total disregard for Terri as his wife," Bob Schindler said. "He is married to Terri, but he is living with another woman and he has two children by her. It has become quite obvious that his priorities are not in Terri's best interest."
The Schindlers' attorney, David Gibbs, said the divorce effort is unprecedented, and would allow Terri Schiavo to end her marriage to Michael even after she dies.
The Schindlers and their son-in-law have fought each other at every level of the Florida court system since the late 1990s on whether Terri Schiavo should live or die.
Michael Schiavo says his wife, who has spent 15 years in what doctors call a vegetative state, once told him she would never want to be kept alive artificially. Her parents have fought his efforts but Pinellas Circuit Court Judge George Greer ruled that Schiavo can have her feeding tube removed on March 18.
Michael Schiavo's attorney, George Felos, called the new motions little more than an attempt to clog the case with further delays.
Gibbs said Greer had indicated he will not hear the divorce request and five of the other motions, but that the matters would be appealed.
Also Monday, the couple filed an appeal to overturn Greer's denial of an indefinite stay while they pursue their last legal options. Gibbs said it was not known when the appeals court would act on that motion, or how quickly it would respond to the others coming its way.
Appearing at a rally in Jacksonville, the Schindlers called on Gov. Jeb Bush to look into the circumstances that led to their daughter's 1990 collapse from a chemical imbalance. They asked Attorney General Charlie Crist to investigate whether her civil rights have been violated.
Felos has said that even if Michael Schiavo were to divorce his wife, any new guardian would be obligated to remove Terri Schiavo's feeding tube because the court has ruled it is her wish not to be kept alive artificially.
"I think everyone knows the parents are going to try anything, including throwing in the kitchen sink, to frustrate the court's final judgment and Terri's wishes," Felos said.
Other motions by the Schindlers ask that some news reporters be allowed to see Terri Schiavo's interactions with her parents, since they contend she responds to them; that they be allowed to take pictures with her before she dies and that those photographs not become Michael Schiavo's property, as a current court order now requires; that she be allowed to die at home; and that they be allowed to bury her rather than the cremation her husband has planned.
|
She can be taught to speak again, too, but there is no therapy, even though the husband was granted a HUGE settlement. The parents are willing to take care of her, but for the THIRD time, a judge has ordered that the feeding tube be removed, and that she literally be starved to death.

Ridiculous. If she is to be killed, which I don't approve of, just give her a lethal injection instead of letting her starve!

I'm wondering if Terri wants to die. If she does, then she should be allowed to, but if there is any chance that she doesn't, she should be allowed to live. Starving to death is one of the worst ways to go,

From all indications, she doesn't want to.

Exactly. She's human, why should you want to treat her differently. She's beautiful in her own way.

A lot hinges on whether she actually responds to people. It is understandable if the people who want to keep her alive misinterpret her actions. But if she really does respond to pepole IN ANY WAY, she obviously wants to live.

^Five different experts have examined her, and concluded that she could be taught to speak again, etc... And she very clearly recognizes her mother and father.

In which case, she should be allowed to live. With the right help she should be able to have a reasonable quality of life.

I've heard there are allegations of abuse but I'm not sure by whom, but if it's the husband, I def think he should no longer be taking care of her. I would rather see her taken care of by her mom and dad in that case. I also feel that if she wants to live she should be allowed to live and not die by starvation....what a terrible way to end a life.

I can see both sides of the issue. If she wants to live, and the family wants to stop feeding her or taking care of her and would rather her die... Then she should go into an institution? Because I can understand how the family must feel by having a drag on themselves. (only if that is the case) But yea, it is sad to know that they want to stop feeding her. Do you think they are trying to get her to try to swallow? Maybe TRY or something?

These kind of cases of conterversal, one one hand its almost human, but on the other hand the only way they will let it happen is by starvation one of the wors ways to go. I agree with up abouve if shes to die a Leatle Injection would be the best cousrse, you hear about the bleeding hearts who say its worng blah blah blah, yet in the same sentence will say that lethel injection for executions are the way to go (or what ever dep;ends on the person) anyways im rambleing

She should live, unless she has clearly indicated that she wants to die. Remember Star Trek V? I'd never thought I'd draw a parallel to that travesty, but it did have some good moments. McCoy's father was on life support, and McCoy pulled the plug only months before a cure was found, and he had to live with that guilt the rest of his life.

yeah it's up to her, not her husband. i'm sure it is painful to watch someone go through that, but if she has room for recovery, then i don't see any reason to let her die.

Yeah, I heard that it was her husband who'd abused her. I saw the article, I'll try to find it again.
Her family is more than willing to care for her, it's her husband that wants her gone. And since he's been with another woman, having children w/ her, I mean, why doesn't he just let the divorce go through?

Yes.

I know. The husband should be ashamed. He just wants to move on and marry this other woman--it's not right to end a completely conscious life. She can see, react, speak somewhat, etc. It is NOT a state for euthanasia!
This is WRONG and she should NOT be given assisted suicide--which she hasn't even agreed to!!!

Oh, they don't want to be kind enough to euthenize (sp) her. They are just going to let her starve to death.

Actually, more than that. Dehydrate her. That's what they're really doing. That's worse than starving her to death...But good point.

You do die faster from dehydration than starvation, however. Still, if they do end up going through with it, they should euthanise her. Prison inmates who have the death penalty would die faster than she would through dehydration or starvation.
Anywho, I don't think that the husband is acting in his wife's best interests. She responds to people, and can learn how to talk again. Why kill her? The husband said that she wouldn't want to be kept alive artifically. Yet, I don't think I'd trust his word, figuring he's already moved on to living with another woman and had children with her.

Dehydration is a HORRIBLE death, and you shouldn't even do anything, evan euthanise her. But I agree with the last thing entirely.

Just heard an interview w/ Mel Gibson, this was brought up. He's trying to help her. Draw awareness to the fact that she's only on a feeding tube, not life support.

That's great that he's making it more public! People should know. The husband is just trying to commit murder, that's what it looks to me..!
